Introduction:
Devrims Inc. (hereinafter, "Devrims," "we," "us," "our," any of its businesses, and associates involved in providing the Services) registered office 1942 Blair Avenue, Santa Ana, CA 92705.
"You," "Your," "Yourself," "Customer," or "User" means the user of the Services.
"Services" means any services offered by Devrims Inc on its website and portal, including but not limited to cloud server deployment, application migration and management, and cloud server maintenance.
The Devrims Terms of Service agreement is a policy governing the use of Dervrims Services. These Terms of Service (the "Agreement") are an agreement between Dervims and you ("User" or "you" or "your"). Kindly read the agreement carefully. By using the Devrims Service, you agree to these Terms of Service; if you don't agree, please do not sign up for an account on the Devrims portal.
We reserve the right to review and make changes to this Terms of Service agreement at any time at our sole discretion. Suppose, if we make any changes to this agreement, we will provide notification of such changes on the provided email address during the registration process and these changes will be published on https://devrims.com/legal/. Your continued use of our Services following notification of changes will constitute your acceptance of such changes.
Account Opening:
To use Devrims services, you need to open an account using our signup page hosted on https://user.devrims.com/signup. For opening an account, Devrims require some personal information, i.e., full name and email ID. There are multiple ways to create an account:
You can sign up using your Google account or Github account. We collect your Google or Github profile data if you sign up through Gmail or GitHub, respectively.
If you sign up manually by submitting your Full Name and Email address in the account registration form, you need to set up your Devrims account username and a password which is at least eight characters long. Must contain one uppercase alphabet, at least one number, and at least one unique character. Your password should be strong as per the criteria because Devrims does not accept weak passwords. We store your password in encrypted format in our database. However, your password would never be exposed to anyone within the company or outside the company in any case. We never ask our users to share the password for any activity like resolving your support query over ticket or chat.
Trial Account
To check if the standard of our services meets your expectation level, we offer a Six (06) Days free trial account to our new users without any server and services charges. No payment information is required to launch a server and host your applications during the trial account duration.
There are two system usage-related restrictions on the trial account to avoid misuse of services: 1) You can only launch one server during the trial period. 2) The server plan allowed in the trial account is G-ES without adding any extra storage space.
Once your trial period is over, the system will automatically delete your server and suspend your account. To avoid server deletion and account suspension after trial account expiry, you can add the payment information during the trial period. The system will automatically change your account status from trial to paid once the trial period is over.
Account Eligibility
The user should be at least thirteen (13) years of age, or any higher minimum age in the jurisdiction where you reside, to register an account or access or use the Services. You should be responsible for: User data should be truthful, exact, latest, and meet the company's requirements. We will be contacting you through the provided primary email address in any case. Devrims will not accept incomplete or wrong information provided by the users, and you will face an account registration failure or account suspension issue. Don't forget to maintain and update your account details upon any changes. Users can update their information through the account Profile section available in your Devrims user dashboard. You will be responsible for all the activities and if any violation occurs through your account. The user needs to take a risk for all the legal and illegal access to your account.
Invoice and Payment
Devrims uses the postpaid billing method, which means that the current month's invoice will be charged on the second (2) day of next month.
You agree to timely pay the total invoice amount generated against the use of Devrims services at the end of each month. You agree to the distribution of invoices in electronic format via your registered email address. The system sends an email to the registered email address containing the invoice details; the total charged amount of the invoice will be the total service fees of Devrims services, including cloud server cost. We informed the customer about the invoice details via an email twenty-four(24) hours before charging the total invoice amount.
For payment details, Devrims requires your card number, card expiry date, and CVV code of your card. Once you provide your payment details, it directly sends to the third-party payment gateway. Devrims does not store the user's complete payment details for securing this sensitive data. We only save the user's payment card's last four-digit and card expiry date only for the ease of our users to remind them about the inserted card details.
Devrims offers a postpaid facility to all users. We charge the hourly rate of the server(s) plan you are using based on the number of hours the server is launched, whether it's running or stopped after the month's end. For example, the user launches a server plan that starts from the 1st day of the month at 00:00 UTC and deletes the server on the 23rd day of the month at 14:43 UTC. Based on the above usage, the total number of server-used hours is 543 hours, and the final server cost will be the Hourly Price of Server Plan * 543(Number of Hours). Devrims round up the minutes while calculating the number of hours the server is used. For example, if you use any plan for 14:43 UTC, we will count it as 15 Hours. In the billing generation and deduction process, we will be following the UTC zone throughout the process. We would not be considering the local time zone of the user's residence. We will charge the user at the end of every month, no matter how many days he uses our services. For example, if you use our services in the first four (04) days of the month, we will charge you for those four (04) days at the end of the month. To make it simple, “We only charge you for the server resources you use on an hourly basis. Nothing more, nothing less.”
Devrims notifies the users after invoice generation and invoice deduction through registered email addresses. The duration between invoice generation and invoice deduction is 48 Hours minimum. If any user does not get any billing or payment-related email on his/her registered email address, he/she should notify Devrims promptly.
In payment dispute cases, we expect our users to communicate within 48 hours of invoice generation, so our team will mark your invoice under review and the system will deduct any payment against the under review invoices. To create a payment dispute case, simply log in to your Devrims account and create a Ticket. You can also generate the payment dispute case after invoice deduction against last month's invoice. However, the duration of dispute cases is a maximum of ten (10) working days(Monday to Friday).
Our chargeback policy states that if we refund the user against invoice dispute or SLA credit, we refund the amount in the user's Devrims wallet. At the time of account deletion, if there’s any amount present in your Devrims wallet, we will refund that amount in your bank account.
In late payment cases, we notify the customer through email to resolve the user payment method-related issue and pay the bill before account locking and then account suspension. Our system attempts to settle the overdue invoices after every 24 hours. If the invoice payment fails, the user will get an email from the system to notify the overdue invoice payment failure and system action if the subsequent invoice settlement is also failed.
The system alerts the user via email to resolve the payment-related issue and contact support if the customer needs more time to pay the overdue invoice. The notice period lasts for seventy-two (72) hours after three failed payment attempts of an overdue invoice and your account will be locked but all the services running on your server(s) are fully functional. Your account will be suspended after forty-eight (48) hours of account locking in case the overdue invoice is still unpaid. In account suspension, all the servers and services running on your account will be deleted permanently.
The postpaid limit of every account is USD 100 monthly by default. If the user wants to launch more servers, which will cost more than USD 100 monthly, they need to add a 50% additional amount of the service cost that exceeds the postpaid limit into the Devrims account wallet. The server usage quota is not more than $ 100USD monthly for all users by default. However, users can use more services and increase the usage quota by adding funds to their Devrims account wallet. If we find any user fair in billing, we will increase the usage quota for that user as per the requirement without adding any funds to the wallet.
Account Termination
Devrims take strict actions against the user in case a user violates the explained Terms & Conditions. However, there are some different conditions when Devrims holds power to ban and terminate the user's account. The requirements are as follows:
If a user uploads any 18+ content that contains pornography, adult content, sexual content, or any media related to harassment will lead to the account termination process. We do not bear and provide any leniency in such conditions. We will promptly stop all the servers running on your account and give you forty-eight (48) hours to migrate all your digital media and files from Devrims servers. After forty-eight (48) hours, our system will automatically delete all the server and data permanently.
A user will not upload any content that harasses other parties or any confidential content that leads to a criminal act. Uploading of such content can lead to termination after an investigation process. Devrims does not allow users to upload any copyrighted content if we receive complaints of such content from any source; your account will be put under the review process and suspended if the complaint is genuine.
The infringement of any T&Cs will give the rights to Devrims to ban or terminate your account once our customer success department does the investigation. All T&Cs will be applied to the services we are providing.
There will be no termination fee.
Account Deactivation
We allow our users to deactivate their accounts at any time if they are not willing to use Devrims services. The user can deactivate the account by removing the payment details we ask for at the time of account opening (Note: We do not save the payment details. The PCI compliance third-party payment gateway provider directly fetches all details). Once the user initiates the account deactivation process, we promptly stop all the services running on the account and permanently delete the server, including the data. Once all the services stop and the server is deleted, our system will generate a final invoice and settle the invoice from the wallet or the default payment method of your Devrims account.
The user can access the account and continue using the Devrims services again after account deactivation via adding the payment details again. In the account deactivation process, we always refund the remaining amount of your Devrims wallet via bank transfer in ten (10) working days.
We also deactivate the account in case of an unpaid invoice. In the future, if the user continues using the Devrims services again via adding payment details, the system first charges the previous unpaid invoice before allowing the user to access the system.
Security
We are committed to maintaining the industry's security standards to protect our system, infrastructure, data, client's servers, and client information. We always follow the security standards to protect our system and your servers from malicious activities and provide security and integrity. Devrims is not responsible for any loss, service failure, and harm that occurred due to security-related issues. You acknowledge that we are not liable to fulfill any loss that occurred due to a security incident. Moreover, the responsibility to check the security standards of the services meets industry standards and your security expectation is also yours. You are responsible for setting up the security of your hosted application and implementing the access control policy on the networking ports enabled by you from the Devrims platform. Suppose we found after investigation that our network or system has been affected by unauthorized access or unwanted use that will affect your application and servers. In that case, we are responsible for immediately informing you once the investigation is completed and taking preemptive measures to protect the system for the future.
Copyright
Devrims follow the Digital Millennium Copyright Act (DMCA) of the United States to handle copyright disputes. We will limit the use of services or terminate the user's account who is involved in copyright infringement. If we receive a complaint regarding the use of copyrighted content without permission and the content is hosted via using Devrims services, we will initiate the investigation process. Upon investigation, if the use of content falls under copyright infringement, we will immediately contact the concerned user to remove the content. If the user does not remove the content or again publishes the content after removal, then we limit the use of services or terminate the user account.
In case of any query related to copyright infringes, you can contact Devrims on [email protected]. Our legal team will get back to you within three (03) working days(Monday to Friday).
Third-Party Services
We are not responsible for the availability and performance of third-party services provided to you by Devrims. The third-party services are provided for your help without any Devrims control on the service and product. You take full responsibility and we assume that you are familiar with all risks associated with the use of third-party services. You are responsible for reading, understanding, and following the license policy, terms of services, and privacy policy of third-party services you use via the Devrims platform.
Disclaimer of Warranties
We make no warranties, whether expressed, implied for the services we provide. All the services are provided as available and Devrims disclaims all warranties. Devrims will not be responsible for any damages you may suffer, including data speed, server downtime, application downtime, loss of data, delays, non-deliveries, or service interruptions by any cause or error. In case, Your server is not in running condition due to the unavailability of Devrims services, we will pay the damages against server downtime based on pro-rata hourly charges of the server plan according to the server downtime percentage as mentioned in the Service Level Agreement. If the server downtime is caused due to the unavailability of a cloud infrastructure provider, then Devrims will not pay any damages as mentioned in Service Level Agreement.
Limitation of Liability
You acknowledge the use of Devrims Services at your sole risk. Neither Devrims, its owner, employees, support agent, affiliates, Devrims third-party services provider, merchants, software provider, and anyone involved in providing the services offered by Devrims are responsible for owning the liability caused due to service interruption, unavailability, service performance, security issues, accuracy and reliability of services. Under no circumstances, including oversight, Devrims, its employees, and anyone involved in providing the Devrims services is liable for any damages directly or indirectly caused due to server downtime, application downtime, services interruption, deletion of files due to negligence, unavailability of service, theft, or in any other circumstances.
Governing Law
This agreement and other legal policies published on https://devrims.com/legal/ are governed by and defined under the federal law of the United States, including the non-contractual disputes.
Dispute Resolution
Our legal team is always available to address your concerns without proceeding to a formal legal case. You can email your query regarding any legal issues at [email protected]. We are liable to respond to your concerns within three (03) working days (Monday to Friday) and try to resolve the dispute within ten (10) working days (Monday to Friday). In case the dispute is still not resolved, then any party can file a formal legal case. All the disputes and this agreement are governed by and defined under the federal law of the United States.
Any matter related to the disputes, claims, services, agreement administered by the American Arbitration Association. You acknowledge that the place of arbitration will be Santa Ana, CA and that arbitration will be conducted confidentially without disclosing any information related to it to anyone.

This Devrims Service Level Agreement (SLA) is a policy governing the use of Devrims Services.The SLA addresses the uptime guarantees about the Services we provide to users and user's remedies for our failure to meet such guarantees. The customer’s role is defined as the described compensations in this SLA. However, the exclusive compensations are for SLA events.
We reserve the right to review and make changes to this SLA at any time at our sole discretion. If we make any changes to this SLA, we will provide notification of such changes on the provided email address during the registration process and these changes will be published on https://devrims.com/legal. Your continued use of our Services following notification of changes will constitute your acceptance of such changes.
Service Availability:
Devrims core objective is to ensure that the service is available 99.9% of the time in a month, excluding any downtime due to our cloud partners or system maintenance. The service availability only refers to Devrims Portal and related services.
Suppose Devrims fail to meet the 99.9% service availability guarantee. In that case, you will receive SLA Credits in your Devrims Wallet, which will be used to pay/settle your account's future invoice(s).

Customer Support:
Devrims provides two main support functions, Live Chat, and Ticketing System for all users, twenty-four by seven and three sixty-five days per year. Chat Support is offered to provide basic information about the system and help to resolve the basic issue of your application hosting. The maximum chat duration session is 20 minutes for all users. Our chat agents will generate a ticket on your behalf with the required information to resolve your query if the chat time exceeds. The second support system is the Ticketing System to resolve high-level issues by our lead cloud engineers. The response time of Normal Priority Tickets is four (04) hours, and High Priority Tickets is two (02) hours. We consider the high priority tickets are related to the issues that caused your live website (DNS record pointed to Dervims Server IP) down, server downtime, service unavailability, or inaccessibility. Other types of events rated as High Priority by Customers that don’t match this description will be demoted to Normal Priority by Devrims employees.
Suppose Devrims fail to meet the 99.9% chat support availability and ticket response time guarantee. In that case, you will receive an SLA Credits in your Devrims Wallet upon request by creating a support ticket, which will be used to pay/settle your account's future invoice(s). In case Devrims fail to meet the response time of a Ticket or the 99.0% availability of chat support twenty-four by seven and three sixty-five days per year. In that case, you will receive SLA Credits in your Devrims Wallet, which will be used to pay/settle your account's future invoice(s).

Exempted Downtime:
Downtime caused by any of the below-mentioned situations shall not be included in the covered downtime and shall not be eligible for SLA credit:
- Informed Maintenance;
- Emergency Maintenance;
- Partner Cloud Provider Services downtime;
- Force Majeure Events;
- Beta Services;
- Downtime due to user actions, or any third-party acting on your behalf;
- Unauthorized use of the Services;
- Breach of Agreement and Terms and Condition;
- Breach of Acceptable Use Policy;
If there’s a failure in our fulfillment of the defined service standards under a non-standard environment, customer authored code, or any changes in the services by parties other than Devrims Ltd., you can not claim for any SLA credit, nor you will be entitled to SLA credits or adjustments/compensation of any kind.
SLA Credit Request:
The Devrims users can receive the SLA Credit by creating a support ticket with the subject “SLA Credit Request.” Our billing department will look into the request, and if the customer is eligible for the SLA Credit, then the system will add the SLA Credit on the account wallet after generation of the current month invoice in which SLA does not meet. The SLA Credit will be used to pay your future invoice(s).

Introduction

We do not make any copy of the user's website and servers data other than server resources monitoring details. Once the user stops using the services by deleting the hosted application and server, the application and server data will be deleted permanently, including server monitoring stats stored in our system.

Information We Collect Automatically
We never collect any personal data automatically without your consent that identifies you or your profile. We automatically collect some information when you visit our website or use our services via cookies and other automated tools. The information we collected via automated means does not include personal data like name, gender, age, etc. We only collect the device information, IP address, operating system, date and time of access, language preference, browser name and version, search history, your activities on the device. The purpose of the automated information collection is to provide you a better user experience of our services.
We also determine the approximate location of your device from your IP address. We collect this information to determine the service usage based on location and block access if the user is located where the United States embargoed goods or services and other sanctions by the United States, European Union, United Nations.
Devrims collect the usage information of the offered services through its platform and monitor the activities and actions performed by the user using automated tools. We log all the activities performed by you on the Devrims platform and the outcomes of those activities. We collect and use this information to provide you our services, improve the functionality and feature of services, provide the log details to the customer on demand. We also forecast the most liked and disliked features by users based on this data.

Information We Collect from Third-Party
Other than the information you provided us and collected automatically, we also receive personal information from third parties such as public websites, social networks, affiliate partners, marketing partners, advertisement services, and recruiting agencies. For example, if you sign-up for Devrims using your Google Account, we will receive information from Google about your email address, full name, and Google profile information using authorization.
Third-party services like marketing agencies and affiliate partners also give us information like email addresses and full names of individuals who are not using our services; we use this information for marketing purposes.
No Highly Sensitive Information
We don’t collect, store and use any sensitive information from any sources like third-party. Also, Our system and any representative of Devrims will never take any sensitive information from our users to provide services and support. The sensitive information includes your racial or ethnic origin, political views, religions, sexual orientation, sex life, health condition, medical history, driver’s license number, passport number, social security number, and residential address.

All information we collect from any sources, whether automated systems or users, is safe and secure on our platform. The following points describe the actual use of your data at Devrims. We highly recommend our users go through these points before providing any data.

Information Sharing
We never sell your personal data to anyone, including third-party services. We only share your personal data with the team members and employees of Devrims, also with the third-party associated us for the purposes mentioned below.
- Share your data with our Cloud Infrastructure Partners to provide you cloud server, data storage, and security of the server.
- Different third-party services associated with us to provide technology solutions used in our platform.
- Email service provider for the purpose of communication with you regarding the services.
- Payment service provider to store your payment information and process payments.
- Share your data with our third-party support solutions provider to provide you LiveChat and Ticket support.
- Recruiting agencies for hiring individuals in our team.
- Marketing partner and affiliate to improve our marketing activities and send you promotional and marketing collateral of the services.

- We may disclose your information when disclosure is required to protect the rights, services, and property of Devrims.

Information Retention
We usually delete your information when it's no longer needed for the purpose we collect the information. We are not legally obligated to store your information for a specific time period. Devrims categorize your data into two types, as mentioned below.
1) Data required to use Devrims Services:
All the information you have provided us. Information we collect automatically and information we collect from third-party as mentioned above falls in this category. We always retain the data collected from you during the account registration process and your Devrims profile data during the use of our services and after account deletion. The payment information is stored in a third-party payment processor system and deleted permanently once your Devrims account will be deleted. The data we collected from automated systems and third parties is usually deleted after two months from the data collection. Your core activities-related data in the Devrims platform like Create Server, Add Domain Name, Server Plan details you are using, etc. will be stored in our platform and deleted after five years from the date of creation/occurrence.
2) Data Required to use cloud server and host websites: All the data required to run, operate, manage, and host your servers and websites fall in this category. You have full control over the data stored in the server. Our system has access to your server to perform the required operations like add domain name, install application, etc. but we never store any server and websites data in any format except the server monitoring data to provide you the historical details of the server resources utilization. Once you initiate the website or server deletion process, our system immediately deletes the website or server permanently upon your request, also delete the server monitoring data stored in our system.
Marketing Activities
We may send you emails, messages, promotions, and marketing communications to market and promote our Services using the data collected from the automated systems, third parties, and provided by you. In most cases, we require your consent to send you marketing communications. Suppose you don't want to receive direct marketing communication from Devrims. In that case, you may opt-out of the marketing communications via clicking the "Unsubscribe" button in the communication or email us at [email protected].
Information DISCLOSURES
You have voluntarily given us your consent by providing personal information. You also authorized us to collect, use, share wherever sharing is required to provide services and disclosure of your personal information as mentioned in this privacy policy. You voluntarily authorize us to share your personal information based on all conditions mentioned in this privacy policy. We share your personal information based on the following reasons.

The personal information we collect within your country may be transferred outside of your country to Devrims or its third-party associate for the purpose described in this privacy policy. You voluntarily authorize us to transfer your personal information across the international border by providing us your personal information.
Your Rights
You have the right to change, edit and delete data provided by you at any time via using your Devrims account. The Devrims account registration data can’t be deleted, but you can change and edit it at any time. If you would like to change, edit and delete the personal information that we collected and shared by you, you may sign in to your Devrims account and change it.
